1. General

This site is accessible 24 hours a day, 7 days a week, subject to its closure for maintenance or repair or in the event of force majeure.
The order placed by the Customer implies unreserved acceptance of the general conditions of sale. This can only be deviated from by written agreement from TINJISMAR.
TINJISMAR reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the customer.

2. Order

The order validation process includes several stages during which you must validate a detailed summary of your order and indicate your contact details.
By clicking on the "Validate" button during payment, you confirm your order and declare that you accept all of these general conditions of sale fully and without reservation.

This confirmation as well as all the computer data recorded by TINJISMAR are considered proof of our transactions.

TINJISMAR will send you a summary and an order acknowledgment by e-mail. The sale will only be considered final after the order acknowledgment has been sent to the customer.

TINJISMAR reserves the right to refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or suspicion of a fraudulent order.
Any order implies acceptance of the prices and descriptions of the products available for sale.

The information given by the buyer, when taking the order, commits him: in the event of an error in the wording of the recipient's contact details,
TINJISMAR cannot be held responsible for the impossibility in which it could be to deliver the product.

3. Prices and features

3.1 The price of the products ordered is the price displayed on the Website on the date of the order. The prices displayed include VAT, including the costs relating to the preparation of the package.

3.2 The consumer is required to pay the price of the products ordered at the time of the order on the Website. Payments can be made in Cash.
TINJISMAR reserves the right not to accept certain electronic payment methods.

3.3 Reimbursement to the consumer of the price unduly collected by TINJISMAR in connection with the purchase, by weight, of fresh products; for example, in the event that the consumer orders and pays the price relating to 1 kilo of fresh products, TINJISMAR will refund the counterpart of the price collected if the weight of the product delivered is less than one kilo.

3. Payment

The goods are payable upon receipt of the invoice. Any delay in payment will automatically give rise to a late payment penalty corresponding to the legal interest rate in force.
In the interest of customer protection, TINJISMAR asks each customer, which he accepts:
– to always sign, by himself or the person receiving the packages, the copy of the deliverer’s delivery note,
– in the event of payment by bank cheque, always make checks payable to tinjismar.com.

4. Warranty

TINJISMAR guarantees that its Articles comply with the description of the Articles ordered and meet the normal expectations that the Consumer may have taken into account the specifications of the Article.
The Products are guaranteed against any design or manufacturing defect which would make it impossible to use them under normal conditions.
The choice of Products is made under the sole responsibility of the Customer according to the use for which he intends them.
TINJISMAR cannot be held liable if the defect in a Product or the damage caused is linked to use that does not comply with the Product's intended use: allergies, poisoning, etc.

5. Liability

5.1 – YIBENS SARL cannot be held liable for damages of any kind, whether material, immaterial or bodily, which may result from the misuse of the items sold.
5.2 – In the event of an accident to persons, or damage to goods during delivery, the customer must contact Customer Service in the presence of the delivery driver to indicate the damage that occurred during delivery. The customer must, within 48 hours, confirm the incident by registered letter with acknowledgment of receipt. In any case, after this period, no complaint can be taken into account. A person from the Quality Department will then contact the customer within 72 hours of receipt of the letter in order to establish the possible methods of repairing the damage.
5.3 – The photographs illustrating the products may show minor differences. YIBENS.sarl cannot be held liable in the event of an error in one of these photographs or one of these texts.
5.4 – YIBENS SARL cannot be held responsible for the non-performance of the contract concluded in the event of out-of-stock or unavailability of the product and force majeure. Force majeure includes all cases recognized by case law and any malfunction of the Internet network, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood, fire, etc.

6. Product Availability

The product offers and prices appearing on the site are valid as long as they are visible and available on the site. A product that has become unavailable is indicated as "In replenishment".
It is nevertheless specified that the simple fact of adding a product to the basket does not constitute a validation of the order. In other words, the product may become unavailable between the time of addition to the basket and the validation of the order by the Customer.
Our product offers are offered within the limits of our available stocks. If the product is not available, TINJISMAR undertakes to inform the user, either by e-mail or by telephone as soon as possible.
